FraudNet member for Guatemala, ||Alfonso Carrillo M||, of ||Carrillo Y Asociados, Guatemala|| filed two constitutional protection actions before the Constitutional Court (CC), against the five entities that will appoint the sitting and alternate Constitutional Court Justices, so that they may respect, observe and comply with the requirements that the Constitution orders.
Attorney Alfonso Carrillo filed two constitutional protection actions before the Constitutional Court (CC), against the five entities that will appoint the sitting and alternate Constitutional Court Justices, so that they may respect, observe and comply with the requirements that the Constitution orders.
The entities included in Carrillo’s constitutional protection actions filed on January 30 and February 3, 2016, are the Electoral Tribunal of the Guatemalan Bar Association (CANG, due to its acronym in Spanish), Supreme Court of Justice (CSJ, due to its acronym in Spanish), Congress, Superior University Council of San Carlos University and the President and Cabinet.
The filed actions, which have not been ruled on by the CC yet, intend to force the institutions to comply with the constitutional requirements and merits stated in articles 113 and 270 of the Constitution, which refer to the merits and requirements that the candidates to Constitutional Court Justices must meet.
According to Carrillo, if these necessary activities to assess in accordance with the Constitution are not taken, there is the risk that candidates may be registered without a detailed, documented, rigorous and comprehensive examination having been made to them, because it seems as if the public calling is being “darkened, overlooked or ignored”.
Regarding this subject, the attorney, awaiting a response from the CC, adds: “The media – has informed – about a possible list of candidates already agreed on or arranged behind closed doors by the electing bodies”, which include the CANG, the CSJ, the San Carlos’ Superior Council, Congress and the Executive.
Carrillo’s constitutional protection actions appear within the framework of the calling of the five entities in order to represent them before the Constitutional Court as sitting and alternate Justices.
